LearnPTE - Terms of Service

1. Eligibility and Account Security

You must be at least 18 years old to use LearnPTE. If using the service for a minor, you must be their parent or guardian and accept full responsibility.

You are responsible for maintaining account security and all activities under your account. Keep your credentials confidential and notify us immediately of any unauthorized access. Account sharing is prohibited.

2. Payment Terms and Refund Policy

Payment Processing: Payments are processed by third-party providers. You authorize us to charge your selected payment method for one-time purchases. We offer 7-day Pro and 30-day Pro plans.

Access Period: Your Pro plan access begins immediately upon successful payment and expires at the end of your purchased period (7 or 30 days). No extensions or refunds are provided for unused time.

Price Changes: We may modify pricing at any time. Price changes do not affect plans already purchased but will apply to future purchases.

3. AI Service Limitations and Your Responsibilities

Important Disclaimers:

• No Score Guarantee: Mock test scores are not predictive of actual PTE results and should be used for practice purposes only
• No Affiliation: LearnPTE is not affiliated with, endorsed by, or connected to Pearson VUE or the official PTE Academic test
• AI systems are probabilistic and may produce errors or inaccuracies
• You must verify all AI-generated content and exercise personal judgment
• We provide no guarantee of accuracy, completeness, or test score improvement
• AI outputs may contain biases from training data
• The service provides educational content, not professional advice

You assume full responsibility for decisions based on AI outputs and your use of the service.

4. Prohibited Uses

You may not use LearnPTE for:

• Any illegal activities or regulatory violations
• Unauthorized access, data scraping, or system disruption
• Uploading malicious code or harmful content
• Content endangering minors or promoting violence/hate
• Privacy violations, impersonation, or spreading misinformation
• Fraud, spam, or other deceptive practices
• Generating inappropriate or adult content

5. Data and Privacy

Your Data: You retain ownership of content you input and warrant you have rights to submit it. You're responsible for ensuring data accuracy and legality.

Our Use: We use your data solely to provide and improve our service. We don't train AI models on your data, but third-party AI providers may use your inputs for their training.

Data Retention: We retain your data for as long as your account is active. Upon account deletion, we will delete your personal data within 60 days, except where retention is required by law. Aggregated, anonymized usage data may be retained indefinitely for service improvement.

6. Service Availability and Performance

LearnPTE owns the service, platform, and original content. You may not copy, modify, or distribute our proprietary materials.

By using our service, you grant us a license to use your content for service provision and improvement (aggregated and anonymized). Any feedback you provide becomes our property.

8. Disclaimers and Limitations

Service Warranty: LearnPTE is provided "as is" without warranties. We don't guarantee uninterrupted service, specific outcomes, or PTE score improvements.

Liability Limit: Our total liability is limited to amounts you paid us in the three months before the claim, up to a maximum of $100 AUD.

Indemnification: You agree to indemnify us against claims arising from your use of the service or violation of these terms.

9. Dispute Resolution

Notice Requirement: Before initiating any legal proceeding, you must provide written notice of your claim and allow us 60 days to resolve the issue. Claims must be filed within one year of the incident giving rise to the claim.

Disputes will first be addressed through good faith negotiation. If unresolved within 60 days, disputes will be settled by arbitration through the Australian Disputes Centre in Melbourne, Victoria, under Australian law.

10. Service Changes and Termination

We may modify these terms or terminate your access at any time. Continued use after changes constitutes acceptance.

We're not liable for service interruptions due to circumstances beyond our reasonable control (force majeure events).

11. General Provisions

These terms are governed by Victoria, Australia law. If any provision is invalid, the remaining terms stay in effect.
